Their Purpose:

 

The powers of Congress are their duties necessary to running a country, or in effect, the actual machinery of the nations business required to keep the doors open so citizens can go about their business. These are all things that effect peoples daily lives, and so naturally, we not only have a greater ability to understand, but to develop a knowledge provided we are shown transparency in our government.

It we do not see it, we do not know. This strikes at the heart of liberty, for liberty is wholly contingent upon the transparency in government, so that we may know.

In our Constitution, the key to this transparency is in the Congress’s constitutionally prescribed power, which becomes a fiduciary duty, when Congress performs their function on behalf of the American people.

Herein lies the rub, because Congress has foresworn and abandoned their following power/duty (s).

Most Important Powers:

 

Provide for Defense and General Welfare (actually, this is first on the list of the powers of Congress); Coin Money and Regulate its Value and that of Foreign coinDeclare War, Finance, and Regulate the Armed Forces.

Outsourced: Coin Money etal to the private Federal Reserve Bank, of which they have shared nothing with America for nigh on 100 years; War Powers have been virtually abandoned to the President and arguably the United Nations. The nations defense, its borders, internal threats like Patriot Act I/II, and even the general welfare of the nation are arguably at risk.


Second Most Important Powers:

Borrow Money; Reg. Commerce (foreign & domestic).

Outsourced: Congress only raises the pole to borrow; Commerce has been given to the Commerce Dept (Executive Branch) and the World Trade Organization (WTO).

Third Most Important Powers:

 

Naturalization; Uniform Laws on Bankruptcy; Patents & Copyrights – Promote Science & Arts; Appoint Lower Federal Court Judges; Post Office and Post Roads; Define and Punish Piracy & Felony Against Laws of Nations.

Outsourced: President Obama has apparently usurped naturalization, Science and Arts has been stretched to include the Dept of Education (Executive Branch); and Piracy & Felony has been proposed by the White House, to be transferred to an international tribunal.

Congress’s Get Out of (Jail Free) Responsibility Card: The Necessary & (im)Proper Clause.

 

Ever since McColluch v Maryland (1819), the Supreme Court ruled Congress may do what it thinks Necessary to carry out its powers, but never addressed how it may be Properly addressed, pretending that Necessary and Proper are one and the same. The argument against this thinking is that what may be Necessary must also be Proper, and within the context of maintaining Liberty, Proper must be defined by the maintenance of the powers of Congress being executed within the Public Forum.

All of the above outsourced powers of Congress are not performed and executed in the Public Forum, and therefore fall into the control and operation in the hands of “cunning, ambitious, and unprincipled men”, and thereby constitute “the customary weapon by which free governments are destroyed.”

America has been blinded.

 

These usurpations of the powers of Congress then, are the mechanisms by which liberty and tyranny are measured, and it is quite obvious how America measures up, or in our current state, down. It also makes clear what America must do to return the transparency required to restore Liberty again in America, and the freedom and economic bounty inherent to Liberty.

When these powers are thus usurped, government rules over the people. Conversely, when Congress performs its powers exclusively in the Public Forum, the people rule. Because it is only through this action that the transparency is creates that enables the people render their “Consent of the Governed”. And it is only when the government operates with the “Consent of the Governed”, can it be justified as a government of liberty.

When a government is ruled by the Consent of the Governed, the people rule over their government. When the people cannot provide their Consent of the Governed, we live in tyranny.

Simply put, if we are to expect an economy and civilization blessed with peace and wealth for all members of society, we must all have rule over our government, instead of being ruled by the few. This is the definition of, and the necessity for, Liberty to exist.

And if we prefer to live being ruled by the few, as bad as things are, they will most certainly get much, much, worse. For slavery carries a heavy price, and while no American is willing to pay it, most of America sits like a deer in the headlights.

The fact is, there are only these two choices, and doing nothing is a vote for the current tyrannical fix America is in, which is the very problem that we are all looking for a way to get out of, and back to the way America is suppose to be.

Demand candidates to Congress to reclaim all Powers (Art I-Sec 8-US Con)

DECLARATION of AMERICAN LIBERTY

WHEREAS LIBERTY is defined as that State where the people rule over the government: This Declaration is given to underlining those critical terms required to ensure that Liberty, which is the original intent of our United States Constitution, be restored to the daily governance and operation of our United States Government.
This Declaration of American Liberty supports and is subservient to America’s Declaration of Independence & our U.S. Constitution.
We the People, acknowledge that Liberty requires all powers of the Congress be removed from the access and control of individuals, groups, or agencies; for it is only by usurpation of these powers, that factions gain control over the laws of the land and the lives of her people. It is this criminal and treasonous usurpation of power, that “ is the customary weapon by which free governments are destroyed.”*
Further, that these restored powers of Congress are to be executed under the authority of all the people, re-establishing not only the power of Congress, but also its fiduciary duty to the people. The incorporation of these procedures inherent to Liberty into our government is a touchstone and the very cornerstone upon which we judge our Liberty.
THEREFORE, We the People, hereby sign and resolve ourselves bind our representatives to, Demand:

Article I.
Complete restoration of all constitutional powers of Congress, back to Congress, as written in our United States Constitution, Article I, Sec. 7, 8, & 9, and so restores operational Liberty in the execution of the business of the nation. This causes two things to occur.
a. Liberty replaces our tyrannical centrally planned state. As a nations political model determines its economic model, so will “Liberty, once taken root, is a plant of rapid growth.”**
b. Liberty, by taking power away from public and private agencies, it removes from power the hands of “unprincipled men”*, and ends their means to transfer wealth away from all Americans. This is America’s problem and enemy. Political Liberty is the only solution.

Article II.
Congress wholly conduct and execute all introduction, discussion, compromise, and vote on all Acts, exercising their powers exclusively within the public forum on the floor of Congress, only thus they ensure;
a. Maximum Transparency in the execution of its duty which provides for,
b. True Consent of the Governed as required by our Declaration of Independence. This is the only means by which the people rule.

Article III.
The Necessary and Proper Clause (Sec 8), requires that the word “Proper” means all legislative and policy laws or decrees must be subject to the same process as any Act of Congress, performed exclusively and wholly within its public forum.

Article IV.
Congress must restore to the states those powers not specifically assigned to the Congress, as Congress, in order to perform its own powers/duties, will be pre-occupied in its reclaimed constitutional performance. This natural restriction of time inherent to these powers/duties will weigh in when there are questions.

Article V.
Prosecution of all criminal and treasonous financial crimes prior to, during, and after the financial upheavals of 2008, must be pursued thoroughly regardless of any high standing or collateral impact.
We the People either live in Liberty, or tyranny. We either rule our government, or be rule. We either all enjoy the bounty of our nation, or we wait for scraps from the hierarchy which rules our money, our lives, and our freedom. For Liberty means nothing if tyranny has one hand in your pocket and the other round your throat.
Liberty and tyranny are in dialectic opposition. Each defines the other by which they are not. Everyone must make their choice, and no decision, is a decision for the status quo of tyranny that afflicts and rules our nation today.
THEREFORE, We the undersigned cast our lot and lives for Liberty.
